JUDGMENT / ORDER

The petitioner is aggrieved with Ext.P3 revision of timings suo motu effected without notice to the petitioner. The petitioner admittedly was operating a service with settled timings as per Ext.P1. Purportedly, in compliance with the directions of this Court, as also implementation of D3 circular, the Secretary, Regional Transport Authority passed Ext.P3 proceedings revising the timings of the petitioner. 2. The learned Government Pleader, after perusing Ext.P3, submits that Ext.P3 is not final and objections, if any, are called for. However, it is to be noticed that Ext.P3 revised timings which came into force with immediate effect, and then called for objections.

3. In such circumstances, Ext.P3 would stand set aside. However, implementation of D3 circular if proceeded with, with respect to all stage carriage operators, necessarily Secretary would have reserved the authority to do so, but, however, only with notice to the affected parties, in the present case, the petitioner. Till revision is made, in accordance with law, petitioner shall be permitted to operate as per Ext.P1.
Writ petition is disposed of.
