Learned APP Ms.C.M.Shah waives service of notice of rule on behalf of respondent.
This application is filed by the applicant praying for modification of the condition imposed by the City Sessions Court, Ahmedabad on 11.1.2012 in Miscellaneous Criminal Application No.57 of 2012 by deleting condition no.1 and allowing the applicant to mark his presence with Karanj Police Station for a period of three months.
Considering the averments made in the application and on hearing learned advocates for both the parties, this application is partly allowed. The condition no.1 of order dated 11.1.2012 passed in Miscellaneous Criminal Application No.57 of 2012 by the learned City Sessions Court is hereby deleted and it is replaced by the following condition:
"the applicant shall mark presence before the concerned Police Station on every 1st and 15th day of English Calender month between 11.00 a.m. and 2 p.m. for six months."
Rule is made absolute to the aforesaid extent.
