JUDGMENT / ORDER

Heard learned advocate for the applicant and learned Additional Public Prosecutor for the State.
2. Following aspects are considered :-
(i) The applicant is facing charges for offence punishable under Section 465, 467, 468, 471 and 120B of IPC and Section 12(1((b) of the Passport Act;
(ii) The accusation against the applicant is that the co-accused used the ration card and electricity bill of the applicant for obtaining a second passport. Except this, there is no other accusation;
(iii)There are no criminal antecedents reported.
3. Considering the above aspects, the application deserves to be allowed and the same is allowed. The applicant is ordered to be released on bail in connection with Crime Register No. I -187 of 2009 of Chowk Bazar Police Station, Surat on his executing a bond of Rs.10,000/- (Rupees ten thousand only) with one surety of the like amount to the satisfaction of the lower Court subject to such conditions which the lower Court may deem fit to impose.
4. Rule is made absolute.
5. Direct service is permitted.
