JUDGMENT / ORDER

The petitioner challenges Ext.P7 stop memo issued by the Revenue Divisional Officer on 10.1.2014 directing the petitioner to stop functioning of the M-Sand unit which is situated in Survey No.371/16 of the Vazhakkulam Village. According to the petitioner, on the basis of a complaint given by the 8th respondent Ext.P7 has been issued by the 2nd respondent to stop functioning of his unit. The petitioner also submits that the 8th respondent along with some other people had preferred a suit before the Munsiff Court. On the basis of the complaint preferred by the 8th respondent an enquiry was also conducted by the 5th respondent Village Officer. The complaint is that the land in which the unit is set up is a paddy land, whereas the said land is a rubber plantation and therefore the said contention is absolutely incorrect. The petitioner had WP(C).No.14782/2014-W.
2 submitted Ext.P8 objection before the RDO.

Having regard to the aforesaid submissions made by the petitioner and also having regard to the submissions made by the learned Govt.Pleader I am of the view that the RDO has to enquire into this issue within a stipulated time limit. Accordingly, this writ petition is disposed of as under: The RDO shall consider the proceedings pursuant to Ext.P7, after hearing the petitioner or any other affected parties and the matter shall be disposed of within one week from the date of receipt of a copy of this judgment.
