JUDGMENT / ORDER

HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.33391 of 2014 DATED : 23.12.2014 Between:

HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.33391 of 2014 ORDER:
The petitioner was granted passport bearing No.J 1226467 on 25.09.2010 and is valid up to 24.09.2020. In the said passport against the column of Date of Birth, it was recorded as 10.02.1979 whereas the actual Date of Birth of the petitioner is 03.09.1983. Requesting to correct the entry of Date of Birth in the passport, the petitioner submitted an online application bearing No.14-1006618151 dated 05.08.2014. The said application is yet to be disposed of.
2. Learned counsel for the petitioner submits that wrong entry of Date of Birth was made in the passport. In support of his claim the petitioner has enclosed relevant documents including the certificate issued by the Board of Secondary Education and the Birth Certificate issued by the Greater Hyderabad Municipal Corporation. But so far no orders are passed on the request made by the petitioner. He further submits that the passport authority has directed the petitioner to appear on 31.12.2014.
3. Having regard to the fact that the petitioner has submitted an application for correction of Date of Birth in the passport on 05.08.2014 which is yet to be disposed of, without expressing any opinion on merits, this writ petition is disposed of directing the Passport authority to consider the request of the petitioner for correction of Date of Birth duly taking note of the documents enclosed to the application, in accordance with The Passports Act, 1967 and the rules made there under and the circular/orders issued by the Government from time to time, and communicate the decision to the petitioner within a period of two weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
4. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
