------------------- The petitioner's vehicle bearing Reg.No. KL 14/M 7344 was seized on the allegation of being involved in violation of the provisions of the Kerala Protection of River Banks and Regulation of Removal of Sand Act, 2001. According to the petitioner, his vehicle was not at all involved in the said violation as the same was in the garage during the relevant time.
2. Whatever be the contention urged by the petitioner, it is for the competent authority viz., the second respondent or the learned Magistrate as the case may be to consider the factual dispute involved in the matter.
3. Since the petitioner is not taking in interim custody, there shall be a direction to the second respondent, the competent authority under the provisions of the Act to pass final orders within a period of one month from the date of receipt of the copy of the judgment.
