~ ~ ~ ~ ~ ~ Petition filed under Section 439 Cr.P.C. 2. Petitioner is the 1st accused in Crime No.6 1/2013 of Manjeshwar Police Station registered for the offence punishable under Section 302 read with Section 34 IPC, Sections 201 and 212 IPC and Section 25 (1B) (a) of the Arms Act.
3. The petitioner has been in custody for the period from 18.11.2013 onwards. The final report has been filed in the matter and presently, the matter is pending as committal proceedings.
4. Heard learned counsel for the petitioner and the learned Public Prosecutor.
5. The learned Public Prosecutor has pointed out that the petitioner is an accused in 23 criminal cases, over BA.7053/2014 : 2 :
and above the present case, including cases relating to the offence under Section 302 IPC. Considering the series of serious criminal antecedents on the part of the petitioner, this Court is of the view that the petitioner is not entitled to be enlarged on bail. At the same time, the concerned Judicial First Class Magistrate's Court, which is dealing with the committal proceedings, is directed to expedite the committal proceedings and to commit the case, as expeditiously as possible, for trial to the court of session. If any other accused is not available, his case can be split up and the case against the other available accused along with the petitioner can be committed for trial.
In the result, this Bail Application is dismissed with the aforesaid observations.
