JUDGMENT / ORDER

Petitioner is aggrieved with the recovery steps initiated against him. Petitioner has a claim that he is entitled to some reliefs from the third respondent. However, petitioner does not seem to have moved the third respondent and any relief claimed, would have to be necessarily agitated before the proper forum. This court cannot consider such claims at this stage. In any event, since only instalment is sought for, the recovery proceedings shall be kept in abeyance on the petitioner complying with the directions herein. 2. The learned counsel for the Bank submits that there is an amount of Rs.2,86,789/- due as on 16.06.2014. The petitioner shall be permitted to pay off the sum in 12 monthly instalments W.P.(C) No.15312/2014 2 starting from 17.07.2014 followed up with subsequent instalments on the 17th of each succeeding month. On the entire amount being satisfied, the Bank shall raise a demand for future interest which shall be satisfied as the 13th instalment. In the event of any one default, the Bank shall be entitled to revive the recovery proceedings. The petitioner necessarily can seek remedies before the third respondent but that shall not interdict satisfication of the instalments as directed by this court, and any adjustment can be made only after final orders are passed by the third respondent.
Writ petition is disposed of.
