Petitioners are accused in Crime No.362/2012 of Kasaragod Police Station. Offences alleged against them are punishable under sections 341, 323 and 324 r/w section 34 IPC and also under section 3(1)(X) of SC/ST (PA) Act. 2. First petitioner's case is pending as S.C.No.610/2012 before the Session's Court, Kasaragod. As the second petitioner is absconding his case is pending in L.P.C.No.9/2014 before the same court. Allegations made by the defacto complainant/first respondent against the petitioners is that the petitioners physicality assaulted him and abused him in public by calling the caste name.
3. Heard the learned counsel for the petitioners and the first respondent. Learned Public Prosecutor is also heard.

It is seen from the affidavit filed by the defacto complainant that the parties have settled the dispute through mediation and the defacto complainant has no grievance at present against the petitioners. He would submit that the case against the petitioners can be terminated by quashing the final report. Considering the averments in the affidavit and the fact that there is Crl.M.C. No.2554 of 2014 2 no reason to proceed with the case as the parties have amicably settled the issue, I pass the following orders:-
The petition is allowed. Annexure-A1 final report pending in S.C.No.610/2013 before the Session's Court, Kasaragod against the first petitioner and in L.P.C.No.9/2014 pending before the same court against the second petitioner is hereby quashed.
