JUDGMENT / ORDER

IN THE HIGH COURT OF JUDICATURE AT HYDERABAD FOR THE STATE OF TELANGANA & THE STATE OF ANDHRA PRADESH (Special Original Jurisdiction) TUESDAY, THE TENTH DAY OF SEPTEMBER TWO THOUSAND AND FOURTEEN PRESENT THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No. 26554 of 2014 BETWEEN Mohammed Muneer AND ... PETITIONER A.P.State Wakf Board, represented by its Chief Executive Officer, Hajis complex Public order, Nampally, Hyderabad and others.
...RESPONDENTS The Court made the following:
ORDER:
Heard.
2. Respondent No.2 was appointed as a Mutawali under proceedings of the Board viz., proceedings No.40/21/T/HYD/13, dated 18.06.2014. On and from that date, obviously the Managing Committee, which was earlier appointed by the Board on 24.08.2012, has ceased to have any managing powers not only in view of appointment of Mutawali but also in view of expiry of two years term. Respondent No.2-Mutawali is, therefore, empowered to take all necessary steps for administration of the wakf institution.
3. Petitioner, who claims to be a person interested, does not, however, have any locus standi to espouse the cause of Mutawali, as he cannot be a proxy for the Mutawali. Hence, in view of total lack of locus on the part of the petitioner, the writ petition cannot be entertained.
Writ petition is, accordingly, dismissed. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
