HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.13986 of 2014 ORDER:
The case of the petitioner is that in the year 2004, petitioner applied and obtained granted Passport Bearing No.E 9206154 from the respondent authority on 31.05.2004. In the said Passport, against the entry of Date of Birth, it was recorded as 17.08.1969, whereas actual date of birth of the petitioner is 17.08.1973. Such declaration was made due to mistake and oversight by the petitioner. Petitioner appeared in 10th Class examination in March, 1990 and passed in Compartmental Division. He was issued Memorandum of Certificate. In the said certificate, the correct date of birth is shown. Having realized that wrong entry was made in the passport, petitioner submitted a representation in November, 2012 to the respondent authority. As per the advise given by the respondent authority, petitioner approached the Civil Court by filing O.S.No. 347 of 2013 in the Court of VIII Junior Civil Judge, City Civil Court, Hyderabad. The said suit was dismissed by judgment dated 03.04.2013 observing that petitioner should make a fresh application for correction of his date of birth. Accordingly, on 06.05.2013 petitioner submitted his application.
2. Learned counsel for petitioner submits that even though an application was submitted on 06.05.2013 praying to carry out the correction of his date of birth, so far no orders are passed. Hence, this writ petition.

When the writ petition is taken up for consideration, learned counsel for petitioner as well as learned Assistant Solicitor General have represented that writ petition can be disposed of by directing the respondent authority to pass orders on the representation submitted by the petitioner on 06.05.2013. Petitioner also submits that he may be given liberty to file fresh petition.
4. Having regard to the submissions made, without expressing any opinion on merits, this writ petition is disposed of directing the respondent authority to pass orders on the representation already submitted by the petitioner on 06.05.2013 or on any fresh representation that may be submitted by the petitioner and communicate the decision to the petitioner within three weeks from the date of receipt of copy of fresh representation. There shall be no order as to costs.
The Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
