Case of the petitioner is that he was issued passport bearing No.
J3901841 dated 14.3.2011 and in the said passport his date of birth was wrongly recorded as 10.6.1950. Having realized the entry of wrong date of birth as 10.6.1950 instead of 10.6.1960, on 21.7.2014 he submitted an application for correction of entry of date of birth in the passport and the said application was received by the Passport Authority and numbered as File No. HYD 3077827067714. Subsequently, petitioner also invoked the jurisdiction of Civil Court to obtain the decree for date of birth and filed O S No. 1345 of 2014 on the file of the III Junior Civil Judge, City Civil Court, Hyderabad seeking a declaration that his date of birth is 10.6.1960. The suit was decreed on 8.10.2014 as sought by the petitioner. According to the petitioner, enclosing the copy of the decree, further representation dated 18.7.2014 was made but so far no further orders are passed on the said application filed by the petitioner for correction of date of birth in the passport.
Learned counsel for petitioner submits that there is no justification to keep the application for correction of date of birth pending for such a long time and delay in correction of date of birth is causing grave hardship to the petitioner.
Having regard to the submission of the learned counsel for petitioner, without expressing any opinion on the merits, writ petition is disposed of directing the respondent-Passport Authority to consider the application submitted by the petitioner on 21.7.2014 along with further representation dated 8.10.2014 enclosing the decree dated 7.8.2014 passed in O S No. 1345 of 2014 on the file of the III Junior Civil Judge, City Civil Court, Hyderabad, if the same is submitted to respondent and pass appropriate orders as warranted by law regarding the claim of the petitioner for correction of date of birth within two weeks from the date of receipt of copy of this order. No costs. Sequel to the same, miscellaneous petitions, if any, stand dismissed.
