1 The present application is filed under Section 439 of the Criminal Procedure Code for releasing the applicant accused on temporary bail for a period of 30 days for the purpose of looking after, attending and making financial arrangements for the medical treatment and operation of appendectomy of his wife.

Sindhi, learned Advocate for the applicant and Mr. R.C. Kodekar, learned APP for the respondent State. I have also perused the medical certificate produced by the learned Advocate for the applicant. The Doctor opined that the wife of the applicant is advised for appendectomy operation. Considering ground advanced by the applicant, I am of the opinion that the present application requires consideration. Hence the following order is passed.
3 The present application is allowed. The applicant accused is ordered to be released on temporary bail for a period of two weeks from the date of his actual release on executing a personal bond of Rs. 10,000/- (Rupees ten thousand only) to the satisfaction of the Jail Authority with the further condition that he shall mark his presence before the concerned police station once in a week during his temporary release between 9.00 a.m. and 6.00 p.m. He shall surrender to the Jail Authority on completion of the temporary bail period without fail.
4 Rule is made absolute to the aforesaid extent only. Direct Service is permitted.
