Heard Mohd Nasir, learned Counsel for the petitioner, Sri Punit Kumar Gupta, learned counsel for the respondent Nos. 2 and 3, learned Standing Counsel for the State and perused the record.
By means of the present writ petition under Article 226 of the Constitution, the petitioner has sought relief in the nature of mandamus commanding the respondent No.2, namely, Chairman, U.P. Sunni Central Waqf Board, Lucknow to consider and decide the pending application of the petitioner regarding inclusion of a masque in the property of the Waqf which is already registered with the Waqf Board.
Learned counsel for the respondent Nos. 2 and 3 has no objection in case if a direction is issued to the Waqf Board to decide the pending application/ representation of the petitioner within stipulated period of time.
In view of the above, the writ petition is disposed of with a direction to the respondent No.2 to consider and decide the application/ representation of the petitioner on its own merit within a period six weeks from the date of production of certified copy of the order.
