1. The present Civil Revision Application u/s.29(2) of the Bombay Rent Act has been preferred by the applicants herein - original defendants - tenants to quash and set aside the judgement and decree dated 30/11/2000 passed by learned Small Causes Court, Ahmedabad in HRP Suit No.962 of 1993 as well as the impugned judgement and order passed by learned Appellate Bench of learned Small Causes Court, Ahmedabad in passing eviction decree against the applicants herein - original defendants - tenants.
2. Today when the present Civil Revision Application is taken up for final hearing, Mr.Tirmizi, learned advocate appearing on behalf of the applicants and Mr.Prachhak, learned advocate appearing on behalf of subsequent purchaser of the suit property as well as Mr.M.B.Gandhi, learned advocate appearing on behalf of the respondent herein - original landlord have stated at the bar that the parties have settled the dispute amicably and the applicants have handed over peaceful and vacant possession of the suit property to the subsequent purchaser. They have produced on record xerox copy of the agreement dated 09/08/2010 showing that the applicants herein - tenant have handed over peaceful and vacant possession of the suit property to the subsequent purchaser, which is directed to be taken on record. In view of the above, learned advocates appearing on behalf of the respective parties have requested to dismiss the present Civil Revision Application as having been infructuous.
3. In view of the above, the present Civil Revision Application is dismissed as having been infructuous as no cause survive as the applicants herein- tenants have handed over peaceful and vacant possession of the suit property to the subsequent purchaser. Rule is discharged. Ad-interim relief, if any, stands vacated forthwith. No costs.
