1. This application has been preferred seeking temporary bail for a period of 30 days on account of operation of the mother.
2. Heard learned advocate for the parties.
3. The applicant accused is allegedly involved in a case as C.R No. I-114/09 for the offences punishable under section, 302, 292, 328, 120B and 201 of the IPC.
4. On earlier occasion on the very ground he has been enlarged on bail when this Court passed order in Criminal Misc. Application No. 8278 of 2012 and Criminal Misc. Application No. 9244 of 2012 (Coram : J. C Upadhyay,J.) was dismissed on account of the same having become infructous.
5. In this application once again on identical ground the petitioner has sought enlargement for a period of 30 days. Certificate of Dr. Pradip B Seju is produced. It indicates that the surgery which was scheduled on 4th July 2012 has been rescheduled on 13th July 2012.
6. Learned advocate urges that as nobody was there surgery is not to be performed today. Considering the fact that he has earlier availed temporary bail for the same purpose and surgery is postponed on different dates, this Court is of the opinion that this application does not deserve to be entertained and accordingly stands disposed of.
