1. The present application is filed by the under-trial prisoner seeking temporary bail for a period of 30 days in connection with C.R. No.I-343 of 2011 registered with Sayajigujn Police Station, Vadodara. The ground for seeking temporary bail is illness of his father, who is hospitalized since 30.04.2012 for heart and kidney ailment.
2. Rule was issued on 15.05.2012 returnable on 18.05.2012.
3. Learned Advocate for the applicant submitted that the applicant was released on temporary bail for a period of 3 days with Police Escort, where he reported in time.
4. Learned APP submitted that since the applicant is an under-trial prisoner, in the event the Court is releasing him on temporary bail, the same may be on stricter conditions.
5. For the contents of the application, the same is allowed. The applicant-under-trial prisoner is ordered to be released on temporary bail for a period of 2 weeks from the date of his release, on his depositing a sum of Rs.5,000/- (Rupees Five Thousand Only) before the Jail authorities and on conditions that:-
he shall mark his presence at the concerned Police Station every alternate day.
in the event he is required to leave local limits of Vadodara, he shall intimate about the same to the police authorities.
6. The applicant shall surrender to the Jail authorities on expiry of the temporary bail period.
7. Rule is made absolute.
Direct service permitted today.
