Heard Mr.Y.V.Vaghela, learned advocate for the petitioner, and Mr.Nisha Thakor, learned Assistant Government Pleader for the respondent State authorities on advance copy.
Mr.Vaghela, learned advocate for the petitioner, does not press this petition qua prayers at Paragraph Nos.11-(C) and 11-(D) at this stage.
As far as prayer at Paragraph No.11-(B) is concerned, Ms.Thakore, learned Assistant Government Pleader, on instructions, states that respondent No.2-District Collector, Junagadh has already called for report from respondent No.3-Deputy Collector, Keshod, Dist. Junagadh and on receipt thereof, the representation/complaint dated 04.02.2012 (at Annexure-A to the petition) made by the petitioner shall be decided after giving an opportunity of being heard to the petitioner. It was further submitted that respondent No.3 may also be directed to submit his report as directed by respondent No.3 within some stipulated time.
Considering the aforesaid, the petition is disposed of at this stage by issuing the following directions in the interest of justice:
(i) Respondent No.3-Deputy Collector, Keshod, Dist. Junagadh shall expedite the submission of report latest by 20.08.2012 to respondent No.2-District Collector, Junagadh, as per communication dated 17.04.2012;
(ii) Upon receipt of such report the competent authority, before whom the representation/complaint dated 04.02.2012 (at Annexure-A to the petition) is made by the petitioner, shall pass a reasoned order, after hearing the petitioner as expeditiously as possible, preferably within a period of 08 (eight) weeks from the date of receipt of the report as per the aforesaid communication dated 17.04.2012.
With these observations, the petition stands disposed of at this stage. There shall be no order as to costs.
