1. Mr.
R.C.Jani, learned Advocate for the petitioner has submitted that though the hearing was scheduled for 17th July 2012, the Charity Commissioner has deferred the hearing on the ground that petition is pending in this Court.
2. This Court has yet not issued notice in the petition and has not entertained the petition. Therefore, there is no reason, much less any justification to adjourn the hearing on the pretext that the writ petition is pending in this Court. When the petition is yet not entertained, particularly because the hearing was scheduled to take place on the same day, there is no justification for the Charity Commissioner to adjourn the hearing.
3. It will be open to the petitioner to make appropriate application to Charity Commissioner to take up the proceedings which are pending for hearing immediately. S.O. to 27.07.2012.
4. It is again clarified that this Court has yet not entertained the petition and therefore there is no need to defer the hearing on the ground of pendency of the petition in this Court.
