Case called out.
None responds for the petitioner to press this writ petition.
The petitioner who is engaged in the business of contract, was given the order for supply of 1500 Cubic Metre fine sand but he failed to supply the aforesaid quantity, He has supplied the demanded sand but was not given any payment insptie of several request. Inspite of making payment the opposite party no.2 vide his letter dated 13.3.1997 fixed the liability of rs. 15,000/- agaisnt the petitioner and claimed this amount from him. Petitioner made a reference to opposite party no.1 for settlement of dispute between the petitioner and the opposite party no.2 regarding payments of petitioners due balance amount agaisnt the opposite party no.2 towards supply of sand. The Additional Cane Commissioner (Administration) was appointed the arbitrator. The Arbitrator after hearing the parties passed an award on 17.4.2002 on merits directing the opposite party no.2 to pay the balance due to the petitioner. Against the award an appeal was filed before the opposite party no.1, who set aside the award on 12.7.2004. Being aggrieved thereof, instant writ petition has been filed.
We have perused the impugned judgement dated 12.7.2004.
We do not find any illegality and infirmity in the impugned judgment, as such the writ petition being devoid of merit is hereby dismissed.
