Heard learned counsel for the petitioner and learned A.G.A. for the State as well as perused the record.
This writ petition under Article 226 of the Constitution of India has been filed by the petitioner for quashing the impugned First Information Report dated 3.8.2010 lodged by opposite party no.4 in Case Crime No.122 of 2009 under sections 363, 366 I.P.C. and section 3(ii)(v) SC/ST Act, Police Station Sujauli, District Bahraich for directing the opposite parties not to arrest him in pursuance of the impugned First Information Report.
Learned A.G.A. opposed the petition.
We have considered the submissions of learned counsel for the petitioner learned A.G.A. and have gone through the contents of the First Information Report which discloses commission of cognizable offence, as such, we are not inclined to interfere with the First Information Report.
The writ petition is, therefore, dismissed.
