Mohammad Sameed @ Sufi vs State Of U.P.

High Court Of Judicature at Allahabad|11 December, 2014

JUDGMENT / ORDER

Ref: Crl. Misc. (Correction) Application No.408377 of 2014.
Heard Sri Brijesh Kumar Srivastava, learned counsel for the applicant and Sri R.K. Maurya, learned AGA for the State.
The correction application which is filed on behalf of the applicant in the aforesaid case shows the carelessness and non-seriousness of the learned counsel for the applicant who has not taken care to read it before filing the same. Moreover, the Registry of this Court or office of the Government Advocate have also not care to see irregular typing of the correction application which shows how the Registry of this Court and office of the Government Advocate are careless in receiving the said application, which is filed in the Registry keeping their eyes shut and sent to the Court directly and the precious time of the Court is wasted in entertaining such applications which are defective. When the said defect is pointed out to the learned counsel for the applicant and concerned persons who have checked the said applications before sending to the Court only tendered their unconditional apology.
The Court feels that tendering of unconditional apology by the respective persons who are found at fault is not solution to growing problems and situation which the Court has to face in its day to day work. It is painful to the Court to remind the learned counsel for the parties, Registry of this Court and Government Advocate time and again to improve such situations. The Registrar General and the Government Advocate have been summoned by the Court who appeared before the Court and seen the present correction application. They were also shown their distress, pain and carelessness in which the said application has reached to the Court and has assured the Court no such instances would occur again in future.
Lastly, learned counsel for the applicant prays that he may be permitted to withdraw the present correction application with liberty to file fresh.
The present application is dismissed as withdrawn with liberty to file fresh.
Let a copy of this correction application along with this order be placed before the Registrar General of this Court and Government Advocate who shall submit the report accordingly regarding the steps taken by them to improve the situation that no such instances would be seen by the Court again.
