JUDGMENT / ORDER

Court No. - 85
Case :- MATTERS UNDER ARTICLE 227 No. - 3276 of 2021 Petitioner :- Mohammad Salim And 5 Others Respondent :- Roshan Tara Counsel for Petitioner :- Khurshed Alam
Hon'ble Gautam Chowdhary,J.
Heard learned counsel for the petitioner, learned A.G.A., and perused material on record.
This petition under Article 227 of the Constitution of India has been filed for setting aside the order dated 12.02.2021 passed by learned Additional Sessions Judge, Room No.3, District Deoria in Domestic Violence Appeal No. 15 of 2019 SNR No. UPDEO10011312019, whereby appeal filed by the respondent no.2 has been allowed setting aside the order dated 14.03.2021 and remanded the matter to trial Court to consider and decide the matter matter in accordance with law.
Perusal of the impugned order shows that the Court below has remanded the matter to the trial Court to decide the same in accordance with law, and therefore in the opinion of this Court there is no illegality or impropriety in the order impugned, which may warrant any interference by this Court under supervisory jurisdiction of this Court under Article 227 of the Constitution of India.
Accordingly, the instant petition lacks merit and is dismissed.
However, it is expected that the trial Court may consider and pass appropriate order on remanded matter preferably within a period of three months, without granting any unnecessary or long adjournments to either of the parties, if there is no other legal impediment.
