Heard learned counsel for the petitioner and perused the record.
The instant writ petition has been filed for issuance of mandamus commanding the respondent no.2 to decide Small Cause Suit No. 31 of 2017 (Mohammad Qamar Vs. Gurmeet Singh) pending in the court of Judge Small Cause Court, Bareilly.
It is submitted by learned counsel for the petitioner that examination-in-chief of the plaintiff-petitioner has already been recorded but the said witness (PW-1) has not been cross-examined till date and the suit is pending since 2017. It is next submitted that due to dilatory tactics adopted by the respondents, the matter is held up.
Under these circumstances, direction is issued to Judge Small Cause Court, Bareilly to look into the matter and conclude evidence of the parties within three months and decide Small Cause Suit No. 31 of 2017 (Mohammad Qamar Vs. Gurmeet Singh) as expeditiously as possible, without granting unnecessary adjournment to either of the parties, preferably within a period of six months thereafter from the date of production of certified/computerized copy of this order.
The concerned Authority/Official shall verify the authenticity of computerized copy of this order from the official website of High Court Allahabad and shall act accordingly without waiting for submission of the certified copy of this order.
Writ petition is, accordingly, disposed of.
