Heard learned counsel for the petitioner.
The petitioner has filed the present petition for a direction to the learned Judge, Small Cause Court, Bareilly to decide Small Cause Suit No. 26 of 2017 (Mohammad Qamar v. Asgar Khan) within a specified time frame.
Learned counsel for the petitioner submits that the defendant- respondent has appeared in the said suit on 06.10.2017 and is contesting the proceedings and repeated adjournments are being sought by him.
I have perused the record as well as the order-sheet. From the order-sheet it transpires that the case is being adjourned on one pretext or the other and only the dates are being fixed.
Expeditious disposal of a case is the right of every litigant and it is expected from every court to endeavour to dispose of a case pending before it expeditiously.
Having regard to the facts and circumstances of the case, the Court below is directed to make all possible efforts to decide the aforesaid case in accordance with law expeditiously fixing short dates, without giving any unnecessary adjournment to either of the parties, provided there is no legal impediment.
With the aforesaid direction, this petition is finally disposed of.
