This application under Section 482 Cr.P.C. has been filed for quashing charge-sheet dated 15.10.2016 as well as entire proceeding in Case No. 55332 of 2016 (State vs. Zakir @ Kallu and others) arising out of Case Crime No. 264 of 2016 under Section 323, 504, 506 IPC arising out of NCR No. 264 of 2016 dated 10.9.2016 under Section 323, 504, 506 IPC, P.S. Chakeri, District Kanpur Nagar.
It is urged that the applicant is facing criminal case in which he was bailed out. On misuse, the bail of the applicant has been cancelled. It is urged that the subsequent FIR was lodged with mala fide intention, to ensure that the applicant stays behind the bars.
Contention on behalf of the applicant cannot be gone into on mere apprehension and assumption the charge-sheet has been filed after investigation, admittedly, on being enlarged on bail in the earlier case subsequent offence was committed by the applicant, consequently his bail in the earlier case has been cancelled.
Learned counsel for the applicant failed to point out any illegality, infirmity or perversity in the impugned order.
The petition being devoid of merit is, accordingly, dismissed.
