JUDGMENT / ORDER

THE HON’BLE SRI JUSTICE C.V. NAGARJUNA REDDY WRIT PETITION No.33050 of 2014 Dated: 06.11.2014 Between:
Mohammad Monir Mohammed and 4 others .. Petitioners and The Osmania University, Rep. by its Registrar, Hyderabad – 500 007 and 3 others.
Counsel for the Petitioners: Mr.MAK.Mukheed Counsel for respondent Nos.1 & 2: Mr.Deepak Bhattacharjee, SC for OU The Court made the following:
ORDER:
.. Respondents This Writ petition is filed for a Mandamus to declare the action of the respondents, in detaining the petitioners, who are five in number, in B.E III year (Semester II), B.E. II year (Semester II), B.E.II year (Semester II), B.E.III year (Semester II) and B.E. III year (Semester II) respectively on the ground that they have more than 12 backlogs, as illegal and arbitrary.
At the hearing, learned counsel for the petitioners has not disputed that as per the Regulations of respondent No.1- University, if a student has more than 12 backlogs, he/she is not entitled to promotion to the next year. It is also not disputed by the learned counsel that each of his clients has more than 12 backlogs.
In the face of these admitted facts, the detention of the petitioners in their respective academic years of B.E course, which is in conformity with the University Regulations, cannot be termed as illegal or arbitrary. This Court cannot entertain any writ petition and grant relief, which runs contrary to the University Regulations.
Therefore, I do not find any merit in this Writ Petition and the same is, accordingly, dismissed.
As a sequel to the dismissal of the Writ Petition, W.P.M.P.No.41341 of 2014 shall stand disposed of as infructuous.
