Heard Shri Subhash Chandra Mishra, learned counsel for the petitioner, learned standing counsel for the respondents no. 1 to 4 and Shri Diwakar Singh, learned counsel appearing for the respondent no. 5.
The petitioner in the writ petition is seeking a direction to the respondents to remove the illegal encroachment of the respondents no. 6,7 and 8 from Gaon Sabha land i.e. Plot No. 385 area 0.0260 hectare situated in village Kishora Pargana Kewai, Tehsil Handia District Allahabad, which is stated to be recorded in chak marg in the revenue record. The relevant extract of revenue record has been filed as Annexure-2 to the writ petition.
No useful purpose would be served in keeping this writ petition pending.
This writ petition is therefore disposed of with a direction to the respondent no. 4-Tehsildar Tehsil Handia, District Allahabad to enquire into the matter and take appropriate action in accordance with law within a period of two months from the date of receipt of the certified copy of this order.
It is made clear that the court has not adjudicated the claim of the petitioner on merit.
