Heard Sri K.K.Tiwari, learned counsel for the petitioners, Sri G.P.Singh, learned AGA for the State and perused the record.
This petition has been filed with the prayer to direct the respondent no.3 (Station House Officer) not to take any coercive measures or not to arrest the petitioners without lodging the FIR.
Learned counsel for the petitioners submits that there is a tenancy dispute between the parties but without there being any FIR, respondent no.4 in collusion with police is harassing the petitioners,hence, the petitioner has come up before this Court with the aforesaid prayer.
Learned AGA has drawn the attention of the Court towards the prayer made in the petition.
After having considered the submissions advanced by learned counsel for the parties, we find that admittedly there appears to be no FIR lodged against the petitioner, hence, we do not find any good ground to interfere in the matter. The writ petition is, accordingly, dismissed.
