Heard Sri A.P. Dubey, learned counsel for the petitioner, Ms. Manju Thakur, learned A.G.A. and perused the impugned F.I.R. as well as material brought on record.
This petition has been filed by the petitioner with a prayer to summon the respondents before this Hon'ble Court in non compliance of the order dated 3.5.2018 passed by this Court in Crl. Misc. Writ Petition No. 11341 of 2018.
Learned counsel for the petitioner submits that the petitioner is the accused in the present case. He challenged the F.I.R. of the present case before this Court in Crl. Misc. Writ Petition No. 11341 of 2018 in which his arrest was stayed by this Court vide order dated 3.5.2018 copy of which is annexed at page-27 of the present petition. Thereafter, the police on the pretext of interrogation had called the petitioner and taken some cheque of the petitioner for which he made a representation before the S.S.P. concerned but the same is pending.
Considering the facts and circumstances of the case and the submission advanced by learned counsel for the parties, we are not inclined to grant the prayer made in the present petition, the same is hereby refused.
However, the S.S.P. concerned is directed to do the needful in the matter, if so required in accordance with law at the earliest.
With the aforesaid order, the present petition stands disposed of.
