Heard Sri Sunder Singh, learned counsel for the applicant and learned A.G.A. for the State and perused the record.
It has been contended by the learned counsel for the applicant that the applicant is the father-in-law of the deceased and he is wholly innocent and has not committed any offence, whatsoever. Therefore,the applicant may be released on anticipatory bail.
Learned A.G.A. has vehemently opposed the prayer for bail and submitted that the marriage of the applicant's son was solemnized with the deceased on 31.10.2018 and she was done to death in her matrimonial home on 18.04.2019. The dead body was buried without informing the parents of the deceased. It is further argued that the dead body was exhumed and the post mortem was conducted in which head injuries were found. Therefore, the applicant is not entitled to be enlarged on interim bail.
Without expressing any opinion on the merits of the case and considering the submission advanced, the nature and gravity of the accusation, I find no good ground for grant of bail to the applicant,Mohammad Hanif involved in Case Crime No. 354 of 2019 under Sections 498-A, 304-B I.P.C. and 3/4 of Dowry Prohibition Act, Police Station Surajpur, District Gautam Budh Nagar.
Accordingly, the anticipatory bail application is rejected.
