The dispute in this petition is regarding fixation of the pay scale.

The grievance of the petitioner is that he was entitled for the pay scale provided by the Vth Pay Commission and in pursuance of the G.O. dated 9.1.1998.

Learned counsel for opposite party submitted that in the G.O. dated 9.1.1998 it was provided that the petitioner shall file an option as to which pay scale he will opt and the petitioner had given option for accepting the old pay scale. In view of this factual controversy, the perusal of the record appears to be necessary. learned counsel for opposite party is directed to produce the option given by the petitioner on the next date.
