Heard learned counsel for the applicant and learned AGA for the State.
The present application has been filed for quashing the NBW dated 14.02.2019 by CMM, Kanpur Nagar in case no. 51612 of 2018 arising out of case crime no. 316 of 2017 under Section 376, 313, 506 and 504 IPC, P.S. Railbazar, District Kanpur Nagar.
This is second application filed by the applicant. The earlier application was disposed of on 20.11.2018 by the coordinate Bench of this Court with certain direction to which applicant has not complied with.
I am not inclined to exercise my discretion in favour of the applicant as the second application is not maintainable for the same cause of action.
Accordingly, the application is hereby rejected.
