Counsel appearing for the caveator opposite party has been heard.
The transfer application seeks transfer of proceedings under the U.P. Premises (Eviction of Unauthorized Occupants) Act, 1972 which are pending before the Prescribed Authority, designated under the said Act.
In my considered opinion, this transfer application is not maintainable as the courts constituted under the aforesaid Act, are not subordinate to the High Court.
Even, Stamp Reporter has reported that the transfer application under Section 24 of the Civil Procedure Code, is not maintainable and I agree with the said report for the reasons already given above.
The transfer application is, therefore, dismissed as not maintainable.
