This case is listed peremptorily, but the counsel for the revisionist has sent illness slip.
Heard learned A.G.A. for the State and perused the record.
This revision has been filed against the judgement and order dated 4.4.2009 passed by the Additional Sessions Judge, (FTC) Court no.17, Bulandshahar, rejecting the discharge application of the revisionist under section 315 I.P.C. in S.T. No. 475 of 2008(State Vs. Mohd. Ashraf and others).
Notices have been served on the opposite party no.2, but none has put in appearance on their behalf.
Perusal of the order passed by the court below shows that there is prima faice evidence against the revisionist on record therefore no ground for discharging the application for the offence under section 315 I.P.C. is made out.
Perusal of the order sheet shows that there is interim order dated 18.5.2009. The interim order is vacated.
The revision is disposed of with the direction to the trial court to conclude the trial expeditiously preferably within a period of six months from the date a certified copy of this order is produced before him.
This order shall be communicated to the court concerned by the office forthwith.
