JUDGMENT / ORDER

Heard Sri Praveen Kumar Gupta, learned counsel for the petitioner and perused the record.
Present writ petition has been filed seeking relief to the effect that opposite party no.1-Civil Judge Malihabad Senior Division, Lucknow be directed to decide the Regular Suit No.2229 of 2016 (Mohammad Amir Vs. Saket Kumar and others) filed by the petitioner for permanent injunction.
Learned counsel for the petitioner submitted that the petitioner is the owner of the suit property and on account of interference on the part of the defendants, the petitioner has filed a Regular Suit No.2229 of 2016 (Mohammad Amir Vs. Saket Kumar and others) for permanent injunction before the competent Court of jurisdiction. In the suit, the defendants i.e. 2 to 4, have appeared before the trial Court and submitted their written statement.
It has further been stated by the counsel for the petitioner that despite of filing of the suit for permanent injunction the defendants are interfering in the peaceful possession of the property of the petitioner, in issue, in the suit.
In view of the above the prayer is to direct the competent court to decide the pending Civil Suit expeditiously i.e. Regular Suit No.2229 of 2016 ((Mohammad Amir Vs. Saket Kumar and others).
Considering the facts of the case, the writ petition is disposed of with a direction to opposite party no.1-Civil Judge Malihabad Senior Division, Lucknow to make an endeavor to decide the application preferred by the petitioner under Order 39 Rule 1 and 2 C.P.C. and/or the suit of the petitioner expeditiously.
