Heard learned counsel for the applicants and Sri Vivek Kumar Rai, learned counsel for the opposite party.
The applicant is before this Court for a direction to initiate contempt proceeding against the opposite parties for willful disobedience of the order dated 12.01.2021 passed in Writ Petition No.14296 of 2020 (Mohammad Amar Khan (Minor) and another Vs. Union of India and others).
From perusal of the order dated 12.01.2021 it is clear that the direction was given to the respondent No.5 namely Deputy Chief Security Commissioner, N.C.R., R.P.S.F. Allahabad/Prayagraj.
Today when the matter is taken up, it is informed by Sri Vivek Kumar Rai, learned counsel for the opposite party that there is no such authority is in existence and the appropriate authority is Senior Divisional Security Commissioner R.P.F. Allahabad/Prayagraj who is empowered to take a decision in the matter.
Heard learned counsel for the parties.
In the facts and circumstances of the case, this contempt application is disposed of directing the applicant to submit fresh representation along a copy of this order as well as copy of the order passed in the writ petition before the Senior Divisional Security Commissioner R.P.F. Allahabad/Prayagraj within a period of two weeks from today. If such order have been produced before the Senior Divisional Security Commissioner R.P.F. Allahabad/Prayagraj, the Senior Divisional Security Commissioner R.P.F. Allahabad/Prayagraj to look into the matter and pass appropriate orders on the representation made by the applicant specially in terms of the direction given by this Court in the aforesaid writ petition within a period of two months.
In case, this order is not complied with within stipulated period, the applicant has liberty to file fresh contempt application.
