Short counter affidavit filed on behalf of State is taken on record.
Heard learned counsel for the petitioner, learned A.G.A. and perused the impugned F.I.R. as well as material brought on record.
This petition has been filed by the petitioner with a prayer that suitable direction may be issued to the respondent authorities to conduct fair and impartial investigation or transfer the investigation to some other police station or agency in relation to F.I.R. registered as case crime no.0206 of 2020 under sections 147, 148, 149 and 302 I.P.C., police station Salon, District Raebareli as well as opposite party No.1 to 4 to protect the personal life and liberty of the petitioner.
Learned counsel for the petitioner submits that the petitioner is the informant of the case. He lodged the present F.I.R. on 08.05.2020 but till date neither the investigation has been concluded nor the accused-respondents have been arrested, hence he has come up before this Court by filing the present petition.
Learned A.G.A. has stated that the investigation is pending.
Considering the facts and circumstances of the case and the submissions advanced by learned counsel for the parties, we do not find any good ground to transfer the investigation or any direction to the opposite party No.1 to 4 to protect the personal life and liberty of the petitioner, hence the prayer to transfer the investigation and direction to the opposite party No.1 to 4 to protect the personal life and liberty of the petitioner are hereby rejected. However, we direct the Investigating Officer of the present case to conclude the investigation of the present case and submit a police report before the Magistrate concerned expeditiously preferably within a period of four weeks from the date of production of a certified copy of this order in accordance with law.
The S.P. Raebareli shall ensure the compliance of present order within the aforesaid period.
With the aforesaid order, the present petition stands disposed of.
