By means of this writ petition, the following relief has been prayed for -
"To issue a writ, order or direction in the nature of mandamus commanding the respondent no. 1 (Sub Divisional Magistrate, Tehsil- Phoolpur, District-Allahabad) to consider and decide the Plaint No. 298 of 2013 (Jan Mohammad and others vs. Murali and others) L.R. Act, under Section 41 of Land Revenue Act, and Objection dated 14.05.2015 pending since 18.07.2014 within a period so stipulated by this Hon'ble Court."
The grievance of the petitioners is that proceedings under Section 41 of the U.P. Land Revenue Act instituted by the petitioners in the year 2014 have not been decided finally.
In the aforesaid facts and circumstances, this writ petition is disposed of with the direction that the respondent no. 1 Sub Divisional Magistrate, Tehsil-Phoolpur, District-Allahabad may endeavour to decide the aforesaid case expeditiously, preferably within a period of three months from the date a certified copy of this order is filed before him.
