Heard learned counsel for the parties and the learned A.G.A. for the State.
This application is filed by the applicants for quashing the N.B.W. dated 20.07.2018 passed by Chief Judicial Magistrate, Chitrakoot pertaining to Case No. 1599 of 2018 arising out of Case Crime No. 227 of 2018 under Sections 376 and 328 IPC, PS- Karvi, District- Chitrakoot, pending in the Court of Chief Judicial Magistrate, Chitrakoot..
After arguing at some length, learned counsel for applicants submits that they may be granted ten days protection to pursue the proceedings and apply for bail. He further submits that grievance of applicants would be sufficiently met in case bail application of applicants is considered expeditiously in accordance with law.
In view thereof, it is provided that if the applicants surrender before the Court below within ten days from today and apply for bail, the Court below will consider the same, in accordance with law in view of the observations made in the case of Lal Kamlendra Pratap Singh Vs. State of U.P. reported in [2009 (3) ADJ 322 (SC)].
For a period of ten days, no coercive steps shall be taken against the applicants.
