List revised. Sri Jitendra Singh, learned counsel for the appellants is present, however, no one has put in appearance on behalf of the complainant.
A perusal of order dated 19.02.2018 shows that on the said date also, learned counsel for the complainant was not present as such matter was directed to be listed today as peremptorily and the learned counsel for the appellants was directed to inform about this order in writing within two days to the learned counsel for the complainant.
Learned counsel for the appellants has stated that notice has already been served upon Sri D.K. Singh as well as Sri Vivek Rai, learned counsel for the complainant on 22.02.2018 informing them that the matter will be taken up on 26.02.2018. Though the matter has not come in the daily cause list today but it has been listed in the additional cause list.
In view of the above, we proceed to hear the learned counsel for the appellants who is seeking release of accused-appellant no. 2 Mohammad Shadab on the basis of his juvenility.
Put up tomorrow along with the record of Criminal Appeal No. 8119 of 2009 in the additional cause list.
