Learned advocate for petitioners submit that earlier the owner of the land in question who had challenged the communication of the Executive Magistrate and Mamlatdar, Mundra, Kutchh dated 23.6.2010 directing the respondent No.5 therein who is the complainant in the impugned complaint, learned Single Judge quashed and set aside the communication after considering relevant facts. The complainant has filed this complaint arraigning the petitioners as accused leveling almost baseless allegations which do not disclose any ingredients of the offences and the complaint impugned in this petition is nothing but abuse of process of law.
In view of the above, notice returnable on 21.2.2012. Learned APP, waives service of notice on behalf of respondent No.1.
Meanwhile, ad-interim relief in terms of para 11(c).
Direct service qua private respondents.
