When the appeal came up for hearing on 14.11.2014, we passed the following order :
“The learned counsel for the respondent submitted that the appellant died on 31.5.2006 and his legal representatives have not been impleaded.
The learned counsel for the appellant prays for two weeks' time to get instructions.
Post on 1st December, 2014.”
2. The learned counsel for the appellant submitted that though a registered notice was sent to the appellant, it was returned stating that the appellant is dead.
The legal representatives of the appellant have not come A.S.No.31/03 2 forward to get themselves impleaded. Therefore, the appeal has abated. The appeal is accordingly dismissed as abated.
