THE HON’BLE SRI JUSTICE C.V. NAGARJUNA REDDY CONTEMPT CASE No.1089 of 2014 Dated: 26.09.2014 Between:
Moddu Narsing Rao and others .. Petitioners and Sri J. Swamy, The Tahsildar, Toopran Mandal, Medak District and others.
.. Respondents Counsel for the Petitioners: Mr. M. Rajamalla Reddy Counsel for the Respondents: G.P. for Revenue The Court made the following:
ORDER:
This contempt case is filed alleging willful disobedience of order dated 27.11.2013 in W.P.No.7729 of 2013.
In compliance with Form-I notice, all the three respondents are personally present.
Respondents 1 and 2 filed separate counter-affidavits, wherein they have inter alia stated that the order of this Court has been complied with by determining ex-gratia and paying the same to petitioners 1 to 6. With regard to petitioners 7 and 8, it has been stated that a sum of Rs.5.00 lakhs was paid to their father for an extent of Ac.1.00 and that the remaining Ac.1.00 was re-assigned in favour of Sri Sudarshan and that as neither the original assignee nor the re-assignee was in physical possession of the land on the date of handing over of possession to APIIC on 14.09.2010, ex-gratia was not paid in respect of the said extent of land. Both the respondents have offered unconditional apology for the delay in compliance with the order of this Court.
Mr. M. Rajamalla Reddy, learned counsel for the petitioners, while admitting the fact that his clients, except petitioners 7 and 8, have received ex-gratia, requested for liberty to the said petitioners for instituting appropriate proceedings questioning the decision of the respondents in denying payment of ex-gratia to them.
Having regard to the fact that the respondents have complied with the order of this Court, though belatedly, for which convincing explanation has been offered, the contempt case is closed with liberty to petitioners 7 and 8 in terms of the prayer made and the respondents are discharged from the contempt proceedings.
