JUDGMENT / ORDER

1. Present application is filed through Dinesh Mohan Deva, son of convict No.1-Mohan Deva. Convict No.2-Narshi Deva and convict No.3-Bhimji Deva are real uncle. The temporary bail is sought for a period of 30 days on the occasion of the marriage of the son of convict No.1-Ramesh. The marriage is scheduled on 20/05/2012.
2. Rule.
Mr.Patel, learned Additional Public Prosecutor waives service of notice of Rule. Learned APP made available for perusal jail remarks of all the three convicts. The convict No.1 is in jail for 10 years, 09 months and 18 days; convict No.2 is in jail for 10 years, 08 months and 01 day and convict No.3 is in jail for 09 years, 11 months and 03 days. The jail remarks indicates that they are released on temporary bail and have enjoyed furlough and on all these occasions they have surrendered in time. There is nothing adverse in the jail remarks.
3. For the contents of the application, the same is allowed. The applicant is, therefore, ordered to be released on temporary bail for a period of 20 DAYS from the date of their release on their executing a personal bond of Rs.5,000/- (Rupees Five Thousand Only) each before the Jail Authorities on certain conditions that he will;
a) not leave the State of Gujarat.
b) not indulge in any illegal activity.
c) surrender before the Jail Authorities in time.
4. Rule is made absolute. Direct Service today is permitted.
