Heard Mr. Abnish Kumar, learned counsel for applicant and learned AGA for State.
This application under section 482 Cr.P.C. has been filed for a direction to Court below to decide Case No. 5602 of 2015 (State of U.P. Vs. Savitri Devi and others), arising out of Case Crime No. 10 of 2015, under sections 419, 420, 467, 468, 409, 120B and 471 IPC, Police Station Mohabbatpur Paiensa, District- Kaushambi within stipulated period fixed by this Court.
A division Bench of this Court in Km. Shobha Bose Vs. Judge Small Causes Court 2020 (1) ADJ 531 (DB) has held that it is not proper to issue any positive direction for time bound disposal of any proceedings without ascertaining the position of the workload in the court concern and in the absence of any allegation that the court below is responsible for the delay.
Upon examination of record, the court does not find any good ground to expedite hearing of above mentioned Sessions Trial, which is of the year 2015 itself.
For the facts noted above, present application fails and is accordingly, dismissed.
