Both the accused in C.C.1591/2013 of the Judicial First Class Magistrate's Court-I, Kannur pending trial for the offences under Sections 420 and 409 of the Indian Penal Code, have come up with this Crl.M.C. under Section 482 Cr.P.C. to get Annexure-1 complaint and all further proceedings based on it in C.C.1591 of 2013, quashed.
2. There were disputes between the parties relating to some monitory transaction as well as gold and finally the matter has been amicably settled between the parties. According to the petitioners, presently the complainants have no complaints against the petitioners herein as the matter has been amicably settled between them. All the CRL.M.C.No.3803 of 2014 -: 2 :-
transactions were finalised and settled.
3. Heard learned counsel for the petitioners, the learned counsel for the defacto complainants and the learned Public Prosecutor.
4. Both the complainants have filed a joint counter affidavit by affirming that all the matters in controversy have been amicably settled and they have no complaints against the petitioners. They have entered appearance through their counsel. According to the learned counsel for the complainants also the matter has been amicably settled between the parties. The learned counsel for the complainants affirms that the counter affidavit has been sworn in by the complainant on their on volition. When the matters in dispute are amicably settled and the complainants have no complaints against the petitioners, it is just and expedient in the interest of justice to quash the proceedings referred to above.
In the result, this Crl.M.C. is allowed and Annexure-I CRL.M.C.No.3803 of 2014 -: 3 :-
complaint and all further proceedings based on it in C.C.1591/2013 pending before the Judicial First Class Magistrate's Court-I, Kannur, are hereby quashed.
