Petitioners, who are accused in C.C.1592/2013 of the Judicial First Class Magistrate's Court-I, Kannur pending trial for the offences under Sections 420 and 409 of the Indian Penal Code, have come up with this Crl.M.C. under Section 482 Cr.P.C. to get Annexure-1 complaint and all further proceedings based on it in C.C.1591 of 2013, quashed.
2. There were disputes between the parties relating to some transaction in respect of gold and finally the matter has been amicably settled between the parties. According to the petitioners, presently the defacto complainant has no complaints against the petitioners herein as the matter has CRL.M.C.No.3798 of 2014 -: 2 :-
been amicably settled between them. All the transactions were finalised and settled.
3. Heard learned counsel for the petitioners, the learned counsel for the defacto complainant and the learned Public Prosecutor.
4. The defacto complainant has filed a counter affidavit by affirming that all the matters in controversy have been amicably settled and she has no complaints against the petitioners. She has entered appearance through her counsel. According to the learned counsel for the defacto complainant also, the matter has been amicably settled between the parties. The learned counsel for the complainants also affirms that a counter affidavit has been sworn in by the defacto complainant on her on volition. When the matters in dispute are amicably settled and the defacto complainant has no complaints against the petitioners, it is just and expedient in the interest of justice to quash the proceedings referred to above.
CRL.M.C.No.3798 of 2014 -: 3 :-
In the result, this Crl.M.C. is allowed and Annexure-I complaint and all further proceedings based on it in C.C.1592/2013 pending before the Judicial First Class Magistrate's Court-I, Kannur, are hereby quashed.
