JUDGMENT / ORDER

K.K.SASIDHARAN,J.
This Writ Petition is directed against the order, dated 23 July 2015 in the Original Application in O.A.No.74 of 2012, dismissing the Original Application filed by the petitioner claiming Selection Grade from 1 January 2009.
2. Heard the learned counsel for the petitioner and the learned Standing Counsel for the Southern Railways.
3. The petitioner was not granted Selection Grade on account of the pendency of disciplinary proceedings and later due to the currency of punishment with holding two sets of privilege passes for the year 2009. The fourth respondent immediately after the expiry of the period of minor penalty granted Selection Grade to the petitioner with effect from 19 March 2009.
4.The petitioner has no case that the disciplinary proceedings were not pending against him. There is no question of giving Selection Grade to the petitioner during the currency of the punishment imposed by the disciplinary authority. It is a matter of record that immediately after the punishment period, the petitioner was given Selection Grade. The Tribunal was therefore correct in dismissing the Original Application.
5. In the up shot, we dismiss the writ petition. No costs.
