The writ petition has been filed challenging the order passed by the first respondent dated 30.12.2008 stating that in view of the charges under Rule 17 (b) of Tamil Nadu Civil Services (Discipline and Appeal) Rules the petitioner's request for promotion cannot be considered. In view of the order passed in W.P.No. 4242 of 2009, the request of the petitioner cannot be considered at this stage. Hence, giving liberty to the petitioner to raise the issue of promotion before the respondents depending upon the decision of the second respondent to be made in pursuant to the order passed in 4242 of 2009 .
2. With these observations, the W.P.No. 4243 of 2009 is disposed of. No costs. Consequently, connected M.P. is closed.
